Man admits moving car after fatal accident
A Lithuanian piggery worker has pleaded guilty to moving a vehicle involved in a fatal road traffic collision that claimed the life of local man Frank Nulty.
Evaldas Gailiunas (39) of 44 Lismeen Hills, Ballyjamesduff, had been sent forward for trial to Cavan Circuit Court.
He appeared before Judge John Aylmer at the circuit court last week for arraignment, pleading guilty to moving a vehicle - a blue Mazda 6 saloon reg 151-G-6239 - from the location of a road traffic collision at New Inns, Ballyjamesduff, with the intention of having it repaired thereby destroying evidence before fleeing the jurisdiction.
The offence of perverting the course of justice occurred at a location unknown between the dates of August 18 and September 6, 2022.
He appeared represented in court by barrister Tom Fitzpatrick, instructed by solicitor Niall Fox, who made an application to have the case adjourned to next term to allow for the preparation of a probation report.
It was stated to Judge Aylmer by Mr Fitzpatrick that his client “acknowledged there was a fatality” in respect of the death of Mr Nulty, Drumfomina, New Inns, who died August 19, 2022.
“He is anxious to acknowledge that,” Mr Fitzpatrick said of Gailiunas.
Mr Fitzpatrick pointed out there was no charge before the court in respect of causing Mr Nulty's death, and he added that Gailiunas has “no previous” convictions to his name.
“He has a good work history,” said the legal counsel, asking also that the probation report take into account Gailiunas' suitability to work a period of community service.
Sentencing was adjourned to next term, and the Judge was informed that the court would be asked to take into account a charge of failing to remain at the scene at the same location and time, which could carry a period of disqualification.
