Six-month sentence David O’Hanlon, 9 Laragh Crescent, Cavan was sentenced to six months in prison when convicted of contravening a safety order made at Cavan District Court on June 22 last, in that he did threaten Ann Marie Smith and put her in fear at Creighan, Cavan on October 25, 2010. Judge Sean MacBride also activated a three-month suspended sentence which had been imposed at Cavan District Court on December 31, 2008, when it was alleged in the charge on that occasion that he did put Caroline Martin in fear at her residence at Lakeview, Cavan. Judge MacBride imposed this three-month sentence consecutive to the six months. Jailed for driving while disqualified Patrick McCann, 72 Aughnaskerry Drive, Cavan was jailed for six months when convicted of driving while disqualified at Latt on July 15, 2009. He also got an eight-year driving ban. McCann was sentenced to a concurrent six months when convicted of driving while disqualified at Kinnypottle, Cavan on October 31, 2009. He was also disqualified from driving for ten years. McCann was given a further concurrent six-month sentence for driving while disqualified at Kinnypottle, Cavan on December 10, 2009 and he was also disqualified from driving for 15 years. Recognisances were fixed in the event of an appeal and these were taken up. Order to do 150 hours of community service Brian O’Reilly, 37 St Martin’s Estate, Cavan was ordered to do 150 hours community service when convicted of engaging in threatening and abusive behaviour at Connolly Street, Cavan on July 13 last. A favourable probation report was handed into the Judge in the case. Dumping costs offender over €5K Anthony McCabe, Mayo, Cootehill was fined €1,000 and ordered to pay costs of €4,053.69 for pollution offences. Mr. McCabe pleaded guilty at an October sitting of Cavan District Court to holding waste in circumstances likely to cause environmental pollution and to failing to comply with an enforcement notice. The offences occurred on February 23 and July 29, 2009. The court heard that the dumping had taken place in the defendant’s quarry and he had been served a notice requiring that the produce a report from an environmental consultant. The prosecution told Judge MacBride that the report had “finally” arrived at 4.30pm the day before the court and they were satisfied with it. The 33-year-old defendant is single, runs his own quarry, had no previous convictions and had entered a plea. Commenting on the time it took to resolve the issue, Judge MacBride said the solicitor representing Cavan County Council, George Maloney, “has to be appreciated” for preparing papers and appearing in court six times “at a loss”. A ‘different Mr. Smith’ Judge Sean MacBride said he will give Dean Smith (28), 105 Drumnaveil, Cootehill, the benefit of the Probation Of The Offenders Act in March if he stays out of trouble. The defendant was charged with assault and criminal damage offences in Cootehill over a six-week period in April and May this year. He had pleaded at an earlier court and paid €2,500 in compensation. “I can see a different Mr. Smith before me today,” said Judge MacBride noting that the defendant was fit and not drinking. “Enjoy your sport and stay out of trouble,” he advised, remanding him to March 3 next year to see how he behaves. Drink driving offences Felix McElvaney (41), Drumguill, Threemilehouse, Co. Monaghan, was disqualified from driving for two years and three months (with effect from January 2 next year) and fined €300 for drink driving at Creighan, Cavan on August 21 this year. At the same court, Francis Maughan (45), 28 O’Neill Park, Clones, was disqualified from driving for three years and fined €250 for drink driving at Creighan, Cavan on December 18 last year. Arrest warrants issued Judge MacBride issued a bench warrant at an October sitting of Cavan District Court for Sean Burke (29), Springtown, Granard, Longford when his case was called and a probation report was in court but the defendant was not. After reading the report, the judge told that Mr. Burke had “failed to attend a lot of appointments” and was “at risk of going to prison” in relation to an offence of unlawful possession of drugs. Bench warrants were also issued for the following who failed to appear: Michael Badzo (32), 2 Pairc An Dun, Swellan, Cavan on driving offences; Jimmy Cash (21), 25 Warrenstown Park, Blanchardstown, Dublin 15 on a burglary offence; Kevin McKenna (37), Flat 1, Connolly Street, Cavan and Fairtown Lower, Cootehill Road, Cavan on drugs offences; and Derek Reilly (43), 2 Reask Drive, Commons Road, Navan on a drugs offence. Victim says give compo to charity Adrian Daly (30), Ballymachugh, Kilnaleck is to work 150 hours community service in lieu of three months in prison for a Section 2 assault, which he pleaded guilty to at an October sitting of Cavan District Court. The court heard that the defendant had €400 in court but the injured party wanted that to go to charity rather than be taken as compensation. Judge MacBride directed that the funds be paid to cancer research and remanded Mr. Daly on continuing bail until November 25 for a probation report to be prepared. Drink driving offences Martin Sheridan, Coraweelis, Carrickaboy, Cavan was fined €250 for driving with excess alcohol, reading 73mg/100ml breath at Creighan, Cavan on August 22 last. He was disqualified from driving for three years, effective from April 1, 2011. At the same court, Ruairi Brennan, The Rocks, Crossdoney was fined €150 for driving with excess alcohol, reading 237mg/100ml blood at Farnham Street, Cavan on January 18 last. He was also disqualified from driving for three years. Suspended sentence Rimantas Butkus, 26 Castlegate, Bullock Lane, Cavan and now residing in Ballybofey, was given a suspended six-month sentence for driving without insurance on December 18, 2008 at Drumalee, Cavan. The sentence was suspended on the stipulation that he enter a nominal bond in the sum of €127 for two years and commit no crime. The court heard that he had already been banned from driving for 30 years and Judge MacBride banned him for a concurrent period of 30 years. He was also fined €1,000. Bound to the peace Gerard Keogh, 43 Oakleigh, Old Balreask Woods, Navan was bound to the peace for twelve months in his own nominal bond of €127 and not commit any crime when convicted of having possession of a duly issued prescription, which had been altered with intent to deceive at Market Street, Cootehill on August 8, 2009. Trespassed on building Patrick Pierce, 51 Drumnaveil, Cootehill was given a suspended three-month sentence when convicted of trespassing on a building at 56 Lodge View, Cootehill on May 1, 2010. The sentence was suspended for two years on the stipulation that he enter a nominal bond to keep the peace and commit no crime. Judge MacBride also stipulated that he be reviewed by the Probation Service, with a view to him taking up a trade or going back into the education system.
